What is the Law of Second Chance?
Through Royal Decree-Law 1/2015, of February 27, on the second chance mechanism, reduction of financial burden and other social measures, the so-called Second Chance Law is introduced in Spain.
This norm modifies important aspects of the Bankruptcy Law, recognizing the right of individuals to be able to start from scratch, in the same way that this right was recognized for entrepreneurs and freelancers through the Entrepreneurs Law 14/2013, of 27 December. September.
In this way, many people who are in a situation of great indebtedness will be able to renegotiate their debts as equals with their creditors, and if the restructuring of the debts is not enough, they can be declared insolvent in a bankruptcy procedure framework, liquidate their assets and cancel their debts following a series of requirements, set forth in Article 178 bis “Benefit from the exemption of unsatisfied liabilities”.
